ATHI WATER WORKS DEVELOPMENT AGENCY REQUEST FOR EXPRESSIONS OF INTEREST (CONSULTING SERVICES – FIRMS SELECTION)

ASSIGNMENT TITLE : CONSULTANCY SERVICES FOR ANNUAL ENVIRONMENTAL & SOCIAL COMPLIANCE AUDITS

1. The Government of Kenya has received financing from the African Development Bank towards the cost of implementing the KENYA TOWNS SUSTAINABLE WATER SUPPLY AND SANITATION PROGRAM and intends to apply part of the proceeds for consulting services to carry out annual environmental and social compliance audits ;

2. The consulting services (“the Services”) involve undertaking Environmental & Social Compliance Audits for 12No ongoing projects within the Athi Water Works Development Agency Cluster.

They include :

• Limuru Water Supply and Sewerage Project ;
• Gatundu Water Supply and Sewerage Project ;
• Kikuyu Water Supply and Sewerage Project ;
• Kiambu – Ruaka Water Supply and Sewerage Project v. Makutano-Kenol Water Supply and Sewerage Project vi. Machakos Water Supply Project vii. Machakos Sewerage Project ;
• Mwala Cluster Water Supply Project ;
• Kitui and Matuu Last Mile Water Connectivity (Kitui and Matuu) ;
• Changamwe Repooling Sewerage Project ;
• Construction of Pemba Intake and Treatment Works xii. Construction Works for Water Distribution for Malindi Water and Sewerage Company Ltd (MAWASCO).

3. The scope of services for the Consultant will include but will not be limited to :

• Review of the Bank’s environmental and social policies’ requirements ;
• Review of the applicable national legislations, regulations, norms, standards and procedures, including national legal Authorization, Permits and Certificates required prior to actions ;
• Review of available reports on the project including the project appraisal reports, the Loan/grant agreements, Environmental and Social Management Framework (ESMF) for the program, site specific environmental and social impact assessment reports, resettlement action plan reports, construction environmental and social management plans, the quarterly E&S Safeguards implementation and monitoring reports, any relevant documentation and records available and necessary for the assessment of the project E&S performance ;
• Determining and agreeing on the scope, methodology and specific set of criteria for the compliance audits with the AWWDA ;
• Evaluation of the actual capacity for managing and monitoring implementation of agreed mitigation measures and related E&S safeguards documents applicable to the project, vi. Holding consultation(s) with the relevant regulatory agencies and stakeholders on the status of the project with respect to identified E&S risks and impacts as well as planned and implemented mitigation measures as per the required legal permits and regulations as well as meeting international best practices as per the Multilateral Environmental Agreements ;
• Carrying out project site inspections to assess project implementation activities including management of contractors and related environmental and social risks and impacts ;
• Preparation of a comprehensive Environmental & Social Compliance Audit Reports.

4. The consultancy services will be carried out over a period of 24 Months ;

5. Athi Water Works Development Agency now invites eligible consulting firms (“Consultants”) to Express their Interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. The shortlisting criteria are :

• At least five (5) years experienced in environmental and social audit works in water and sanitation projects including large infrastructure projects ;
• Should be registered with the National Environment Management Authority (NEMA) and should be having current practicing license ;
• Experience in environment and social auditing of water and sanitation projects including large infrastructure projects ;
• Experience in preparing and/or managing the implementation of the Environmental and Social Impacts Assessment (ESIAs), Environmental and Social Management Plans (ESMPs), Environmental and Social Management Frameworks (ESMFs), Resettlement Action Plans (RAPs) of projects financed by AfDB or other DFI will be an added advantage ;
• Experience in carrying out similar assignments in Kenya would equally be an added advantage.

6. Consultants may associate with other firms in the form of a joint venture or a sub-consultancy to enhance their qualifications and experience ;

7. A Consulting will be selected in accordance with the Quality and Cost Based Selection (QCBS) method set out in the Consultant Guidelines ;

8. Further information can be obtained at the address below during office hours from 0800 to 1700 hours (Kenyan local time) from Monday to Friday excluding lunch hour (1300 to 1400Hrs) and public holidays ;

9. Expressions of interest must be delivered in a written form to the address below (in person, or by mail, or by fax, or by e-mail) by 00 Noon East African Time on 20th January, 2022 ;
