Consultancy for drafting of a regulation, guidelines and Training for the implementation of the United Nations Security Council Resolutions on prevention of Terrorism & Terrorism Financing and Proliferation Financing.

Background

The Financial Intelligence Unit (FIU) of The Gambia, is an agency established by the government of the Republic of The Gambia through an Act of the National Assembly to combat Money Laundering, Terrorism Financing and other Criminal Conducts as provided in the said Act (Anti-Money Laundering and Combating of Terrorist Financing (AML/CTF) Act 2012). The FIU works closely with the Financial Action Task Force (FATF) style regional body called the Inter-Governmental Action Group Against Money Laundering in West Africa (GIABA) for the full implementation of the FATF requirements on the prevention of money laundering and terrorism financing.

In the process of executing its mandate, the FIU is required to provide guidance to relevant stakeholders on the implementation of the AML/CTF Act 2012 the FATF Standards and the UN Resolutions on the prevention of terrorism and terrorism financing and proliferation financing. It is against this background that the FIU calls for qualified Consulting firms both locally and internationally with the relevant qualifications and experience to submit proposals for the drafting of regulations and guidelines for the full implementation of United Nations Security Council Resolution (UNSCR) requirements on Terrorism Financing (TF) and Proliferation Financing (PF).

  1. Scope of work

The Consulting Firm will review relevant documents published by the United Nations Security Council Counter-Terrorism Committee Executive Directorate and other relevant sanctions committee on TF and PF, the FATF standards and the relevant laws of the Gambia. The scope of the assignment will cover the following:

  • Draft regulations for compliance with relevant UNSCR on TF & PF
  • Draft guidelines for the reporting entities, Public and Private sector stakeholders for the effective implementation of the draft regulation
  • Provide training to relevant stakeholders on the draft regulation and guidelin
  1. Qualifications and specialised knowledge/experience required
  2. Firm’s Qualification and experience
  • Must have been in consulting advisory services for at least 5 years
  • Must have experience in drafting regulations and guidelines for government entities in the last 5 years.
  • Experience of carrying out similar assignments
  1. Firm’s Experts qualifications, Experiences and Competences
  2. A Master’s Degree in Social Sciences or Law
  3. Minimum of five (5) years’ experience in the areas of AML/CFT, Intelligence analysis, investigations and or law enforcement,
  4. Previous work in a similar role of drafting regulations and guidelines

Personal Competences

  1. Effective communication skills
  2. Able to produce quality work within a given time frame
  3. Able to work independently and have the ability to manage teams.

Duration of the assignment

The assignment should last for a period of Two (2) months from the date of contract signature.

The Inclusive Growth Promotion Institutional Support Project through the Projects Coordination Unit, Ministry of Finance and Economic Affairs now invites eligible Consultancy Firms to indicate their interest in providing these services. Interested Firms must provide information indicating that they are qualified to perform the services (brochures, description of similar assignments, experiences in similar conditions and availability of appropriate skills among staff, etc.). Firms may constitute joint-ventures to enhance their chances of qualification.

Eligibility criteria, establishment of the short-list and the selection procedure shall be by Consultant’s Qualification Selection (CQS) method in accordance with the African Development Bank’s
